YES DONALD, COLORADO DID VOTE…ON MARCH 1ST
- From 1912 to 1988, and since 2004, Colorado used the current system for delegate selection, with no preference vote binding.
- Even in 1992, 1996, and 2004 delegates were bound by vote, but were free to vote conscience on second ballot.
- In 2012, Santorum won the non-binding straw poll but Romney received more delegates at conventions.
- A 2012 rules change at the RNC required any state that held a straw poll to bind their delegates, Colorado chose not to hold the straw poll, to enhance grass-roots participation.
If you’ve been on the internet this morning, you’ve seen the scathing headlines: “Republicans cancel presidential election in CO…” and “Fury as Colorado has no Primary or Caucus,” among others. The problem is that this is not exactly true. Colorado only briefly flirted with a binding primary, but even then the delegates were selected by a caucus-convention system. From 1912 – 1988, and 2004 to the present the delegates were not bound by a preferential vote. This year was no different.
In Colorado, a caucus is held to elect delegates to county assemblies and the county assemblies elect delegates to state and district assemblies where the delegates to the RNC are chosen. That is how it has worked over the past four presidential cycles, and it is nothing new for this year.
First, a little recent history. Conservative Review spoke to Florence Sebern, a member of the 2012 RNC Convention Rules Committee from Colorado. Sebern outlined how the Colorado Republican Party started holding non-binding straw polls to coincide with their caucuses in 2008. Sebern explained the process: “Prior to 2012 RNC rules changes, Colorado’s presidential preference poll (instituted in 2008), did not bind delegates. Delegates could choose to pledge, via the National Delegate Notice of Intent form. A pledge bound delegates through the 1st round of voting.”
The New York Times description of the caucus system in Colorado in 2008 and 2012 confirms this account. In both instances they describe how the delegates are unbound from the results of the straw poll.
So why the change this year? According to Sebern, RNC rules instituted in 2012 said that any state that holds a preference poll in conjunction with their caucuses must bind delegates according to the results. The new rule was 16(a)(1):
Any statewide presidential preference vote that permits a choice among candidates for the Republican nomination for President of the United States in a primary, caucuses, or a state convention must be used to allocate and bind the state’s delegation to the national convention in either a proportional or winner-take-all manner, except for delegates and alternate delegates who appear on a ballot in a statewide election and are elected directly by primary voters.
The caucus system was not fundamentally changed. What was changed was that a meaningless straw poll was not conducted — one that wouldn’t bind the delegates anyway.

Nationally syndicated radio host Mark Levin joined a special edition of Breitbart News Daily this evening to discuss the passing of Supreme Court Justice Antonin Scalia with host Stephen K. Bannon.
“I would count him as a top ten, maybe a top five of all time, and he wasn’t even a Chief Justice,” Levin said of the late Justice Scalia. “This is a devastating loss for people who love this country. It’s a devastating loss for those of us who love the Constitution,” he added.
Scalia, age 79, passed away this evening in Texas. As reported earlier by Breitbart:
Justice Antonin Scalia—one of the most acclaimed legal scholars ever to serve on the Supreme Court of the United States—has passed away at age 79.
Justice Scalia was on a trip hunting quail in Marfa, Texas. He had gone to his room after dinner on Friday, February 12, and made no complaints that he was feeling ill or showing signs of medical distress. When he did not show for breakfast Saturday morning, someone was sent to check his room and discovered the deceased justice.
“It’s an absolute disaster. Let me put it this way, Scalia is kind of the Churchill, the Thatcher, and the Reagan of the Supreme Court. He wasn’t even Chief Justice and yet his impact has been massive as an originalist,” Levin went on.
“The point is, he moved the Court in ways that the Court would never have moved before, even though we have these disastrous opinions coming from the Court, the brilliance of his decisions … he was able to cobble together often four justices, sometimes five justices. He was energetic, he was intellectually bracing. He was by far the leader of that Court, and there are great Justices on that Court,” added Levin.

It’s what I’ve been saying all along, no matter how personally satisfying it is to take a dig at the impersonator-in-chief (and I do so with gusto), since Obama was born to an American parent (his mother), he is in fact a bona fide US citizen, as much as my own children are though they all have been born in Finland. The same with Ted Cruz.
So the issue with Donald Trump throwing up some blue smoke and mirrors around Ted Cruz’s legitimacy in running for US president is very disingenuous, it’s pure political chicanery trying to keep the senator in a defensive mode. The more he denies Trump’s claim, the more he keeps the issue of his birth/citizenship question in the public eye.
NOTE: I would hope that this issue on naturalization will be now answered for all of the TT’s readers.
In the third segment, Levin cited an article by Ilya Shapiro that argued Cruz is eligible to president, although he objected to Shapiro’s claim that “birth within the nation’s territory regardless of parental citizenship” guarantees natural born citizenship. He further stated that attacking Cruz’s eligibility is something liberals have done, and that “using left-wing arguments against a conservative is unacceptable.”
Levin: Cruz Is Eligible — I ‘Don’t Have To Agree’ With Trump ‘Like Our Friends Over at Breitbart’
Talk radio host Mark Levin criticized the questioning of Republican presidential candidate Texas Senator Sen. Ted Cruz (R-TX) 97%, stating, “just because he [Trump] says something doesn’t mean I have to agree with it like our friends over at Breitbart who are going all kinds of crazy over the birther issue” while addressing the issue over multiple segments of his radio show on Wednesday.
Levin began by saying, “I like Donald Trump. I like him a lot. I think he’s done great things in the last six months, but I’m not chasing shiny objects, and I’m not chasing squirrels. And just because he says something doesn’t mean I have to agree with it like our friends over at Breitbart who are going all kinds of crazy over the birther issue.” He added that the birther issue with both Cruz and President Obama is “stupid,” no one has standing to challenge it, no court would take it up, and is “just not true.” Levin continued that “the liberals love this stuff.”
He then turned to the specific claims that Cruz isn’t eligible, saying that both Trump and columnist Ann Coulter have “taken two positions” on the issue. Levin also dismissed claims by Trump that the Washington Post brought the subject up, not him.
Levin then said anyone who is born to a US citizen can run for president, regardless of where they were born. He then read the 5th clause of Article II, Section I of the US Constitution, and argued that children born to US citizens abroad are natural born US citizens under US law.
He continued by pointing to arguments that child born in the US are not automatically natural born citizens under the 14th Amendment, that he and other conservatives have embraced, contrary to the “amnesty crowd, the establishment Republicans, [and] dummies on TV”.
Levin further said, “We’re not liberals. We try to discern the truth. We try to discern the facts. We try to discern the law. We try to figure out what the framers meant in the Constitution. The framers didn’t reject people who were born of American citizens from being American citizens.” He added that the Supreme Court would never hear such a case because almost no one has standing to bring one, and it would be considered a political question by SCOTUS.
Levin then addressed arguments that someone has to be born to two US citizens in order to be considered a natural born citizen by stating that such a rule appears nowhere in the Constitution. He added, “So, rather than being activists, and liberals, and re-writing the Constitution, and trying to change it to accommodate a candidate, that’s not what constitutional conservatives do. That’s not who we are.”
Levin then declared that Cruz’s eligibility was “resolved,” and questions over Cruz’s eligibility are “for the kooks.”
He then argued that the media loves the questions about Cruz’s eligibility, because it takes attention away from President Obama “eviscerating the Constitution” with his executive action on gun control, and that such questions “played right into the liberal’s hands.”
Levin further stated, “I don’t believe in cults of personality. Some websites do. Some commentators do. Fine. I’m not one of them.” And that “chasing another dumbass issue” wouldn’t help save the country, or change a single vote, but only gives the media an excuse to ignore Obama’s gun control actions.

Mark Levin: ‘The Forerunner to War Has Begun’
On his nationally syndicated radio show September 30, 2015, Mark Levin warned that “the forerunner to war has begun.”
“I told you last year this was the start of World War III,” stated Levin, “and here we go, slowly but surely. And this fool, and the fools in the Democrat Party and the fools in the Republican Party, surrendering the treaty provision in the Constitution.
“These fools, these clowns – all of them – have armed up the Iranians,” Levin continued. “The Iranians will now have $150 billion. The Russians are already getting a big chunk of that; the Chinese are going to get a big chunk of that, Hezbollah, Hamas. The battle is on. It’s not a matter of us going to war. It’s not a matter of the Israelis going to war. The forerunner to war has begun.”
What of the Republicans? The Republicans, the Republicans control that building behind us right now. You see that scaffolding up there? They should take some of that and use it on their damn spines.

Wednesday in front of the U.S. Capitol at the rally against President Barack Obama’s Iran nuclear agreement titled “Stop the Iran Deal Rally,” conservative radio host Mark Levin attacked Republicans in Congress for not having gumption to reject the deal.
Levin said, “We are here to tell the world that we, the American people, are more resolute than ever. We are more resolute than ever to destroy those who threaten to wage war against us, our society and our ally, Israel. This enemy makes a grave error in confusing the appeasement of a president and a Democrat party and the capitulation of a Republican Congress with the strength and fortitude of the American people. Never before has a president of the United States, never before has a political party consented to funding or arming the enemy. Never before has a president entered into agreements with a terrorist regime that holds Americans hostage.
That has killed and maimed thousands of American soldiers and that seeks nuclear weapons and ICBMs to attack his own country. Barack Obama makes Neville Chamberlain look like George S. Patton. This phony deal allows the Iranian terrorist regime to inspect its own nuclear sites, to continue uranium enrichment, to build advanced centrifuges, to perfect their ICBMs, to spend $150 billion on terrorism and in the end, to secure nuclear warheads. And as one Democrat after another, one conga line of Democrat after another supports this surrender, it’s clear that the Democrats no longer represent the party of Harry Truman and John F. Kennedy. It’s now the Democrat party of Bill Ayres and Barack Obama. And the Democrat party will have the blood on its hand as a result of this deal for the rest of time.”
Simple facts is, you shouldn’t.
“We have to go over the heads of all these big government institutions and their surrogates in order to inform our children and grandchildren and our neighbors’ children and any people who will listen why, in the first case, liberty is something to be preserved and, in the second case, why centralized big government is something to be opposed,” the author stated. “What I’m saying is let us inform ourselves.”

Talk show host and bestselling author Mark Levin is troubled that young people embrace “big, centralized government” when he believes it destroys their future prosperity.
In the second installment of The Daily Caller’s exclusive, three-part interview with Levin in connection with his new book, “Plunder and Deceit,” the author explains that he wrote his latest work to argue why conservatives need to do a better job of reaching out to millennials. “What big, centralized government is doing to the country generally is catastrophic, but in particular for younger people — 35 and under — it is a disaster,” the radio personality told TheDC. “The case is overwhelming and I do not feel that parents and grandparents and conservatives or constitutionalists make the case effectively or even attempt to to people who are 30, 40 years younger — to their own children and grandchildren.”
“My attitude is: why should we allow the left to continue to destroy the next generation and future generations with out fighting back?” Levin continued. “If we just leave it up to the left, then the left is going to essentially succeed in indoctrinating future generations and transmuting society.”

Levin said he was particularly bothered by the claim—made by politicians on both sides of the aisle—that there are so many so-called “jobs that Americans will not do.” Levin mentioned that, according to the Census, 73% of janitors are American citizens, as are 51% of maids and housekeepers, 58%of taxi drivers, 64% of landscapers, 66% of construction workers, and 72% of bellhops, porters, and concierges.
MARK LEVIN : NUMBERS YOU HEAR ON IMMIGRATION ARE A LIE
Conservative talk radio host and scholar Mark Levin called in to Breitbart News Sunday and blasted “criminal politicians” on both sides of the aisle who keep praising illegal immigrants. Levin emphatically stressed that Republican voters must reject presidential candidates who will not block the left from enacting their radical goals.
Levin, whose new book Plunder and Deceit will be published next month, told host and Breitbart News Executive Chairman Stephen K. Bannon in a wide-ranging interview that conservatives “cannot accept” in this election cycle any candidate who “just wants to get along, show that they can manage” America’s decline.
“We want to elect the most conservative person we can, not [someone] who’s going to support Common Core, who’s going to tell us we have to figure out how to get around the base,” Levin said, in reference to Jeb Bush’s remarks about the need to “lose the primary to win the general” election.
Levin, who is one of the intellectual leaders of the conservative movement, said conservatives need a nominee who “believes in American sovereignty and talks about the Constitution.” He said there are only four or five of those candidates in the field, and “those are the guys I’m going to promote as time goes on.”
That career ladder climbing traitor to constitutional conservatism should have been removed ages ago.
Exclusive — Mark Levin: Boehner’s Retaliation Against Conservatives Means War, Time to Take Him Down
It’s time for conservatives to take out House Speaker John Boehner and all of his comrades in primaries, nationally syndicated radio host, New York Times bestselling author, and conservative movement thought leader Mark Levin argues in an exclusive comment to Breitbart News.
All of this would have been swept under the carpet if they both stayed out of the public eye. But, being Clintons, they believe that they are royalty and need to lead the country again and again.
LEVIN: CLINTONS ‘MUST BE PROSECUTED’
Talk radio host and author of “The Liberty Amendments,” Mark Levin argued the Clintons “must be prosecuted” for their dealings with the Clinton Foundation on Thursday.
Levin said, “we now know that major donors to the Clintons, their so-called library and foundation money laundering scheme, sold half of America’s uranium to Russia. Uranium, used, among other things, for nuclear weapons. 20% of all uranium deposits in the United States are now owned by the Russians. …They must be prosecuted, now these people have been treated like a king and a queen for too damn long.”
Radio talk show host Mark Levin quoting BJ:
“Arguably the most interesting NGO today, which proves the importance of inclusiveness by its shortcomings … is isis … Isis is a terrorist organization trying to become a state….[…] and they set up a judicial system and social services and the only thing is that if you disagree with them, they’ll kill you.”
Levin at the 43 minute mark: ”What NGO? it’s a terrorist operation, it’s a terrorist organization, it’s not a non-governmental organization, that’s like some non-profit group, like the Clinton library, a money laundering operation. And the point is what exactly, what is the point?”
I believe that Levin was right about Clinton’s referencing of NGO (and the banality in the way it was done) but was too focused on it alone (an ill chosen descriptive IMHO, and I loathe Clinton as well). I believe that Baron Bodissey at GOV is right, but in fact, more right than Levin by providing that point Levin himself was seeking:
”Truth From an Unusual Source”, This is a brief but completely accurate summary of what the Islamic State is all about.”
One point that GOV does miss, a but a minor one in comparison, and is picked up by his commenter SYB:
“Arguably the most interesting NGO today, which proves the importance of inclusiveness by its shortcomings … is isis … .” I guarantee you that here Clinton is alluding to the virtue of multicultural inclusiveness that would embrace islam, as opposed to the evil exclusivity practised by isis.
But the bigger issue is this, a notable (but detestable hack) politician is correctly addressing what Islamic State is, and what it’s doing to minorities within its jurisdiction, even mentioning the poll taxes exacted from them, though failing to say jizya by name. At this point, I’ll take any step forward, regardless of who it is and give a tad of kudos to him/her.
Obama couldn’t care less about Israel’s continued existence.
LEVIN: RECOGNITION OF ISRAEL’S RIGHT TO EXIST ‘FUNDAMENTAL’ IN IRAN NUKE DEAL
Talk radio host and author of “The Liberty Amendments,” Mark Levin argued that Iran’s recognition of Israel’s right to exist was a “fundamental” matter in the US’ negotiations with Iran on Monday.
Levin defended Israeli PM Benjamin Netanyahu’s request that any final deal with Iran recognize Israel’s right to exist, stating “so, Netanyahu’s saying ‘well, they [Iran] should at least, any part of a deal, recognize the right for Israel to exist.’ He doesn’t even say ‘as a Jewish state,’ just the right for it to exist.”
Levin then played a clip of State Department Deputy Spokesperson Marie Harf saying the agreement with Iran was “only about the nuclear issue,” and reacted “so if we have a country on our border, or close, let’s say it was Cuba during the Cuban Missile Crisis, and some deal’s being worked out with Cuba and the Russians are putting their nukes there, and you say ‘hey, look, look, look, we just want to control their ability to have nukes, get nukes. Well, Cuba should at least recognize our right to exist’ [we wouldn’t accept] ‘that’s a separate issue.’”
LEVIN: OBAMA BELIEVES ISRAEL IS ‘ILLEGITIMATE’
Talk radio host and author of “The Liberty Amendments,” Mark Levin argued that President Obama believes “Israel as presently formed, as presently exists, is illegitimate” on Thursday.
“This leak means that Obama has decided that Israel has to go, that Israel as presently formed, as presently exists, is illegitimate. That’s why his Chief of Staff spoke to a leftist, Israel-hating group filled with Jews and went on about how Israel has been occupying land for fifty years…not 1967 borders Obama said, pre-1967 borders, which means Israel cannot survive.
”We are not a nation of immigrants, we are a nation of citizens.”
A bold move against tyranny.
Landmark Legal’s argument focuses on founding principles rather than questions of congressional intent. “The very dangers warned about by Locke and Montesquieu and considered by the Framers during the Constitutional Convention have come to pass,” says the brief. “The Judicial Branch should not allow this to continue.”
Citing the Federalist Papers and constitutional scholarship, it also states: “Tyranny flows from the arbitrary wielding of power.”
(Breitbart) – The Landmark Legal Foundation, the conservative public interest law firm founded by talk radio host (and former Reagan administration official) Mark Levin, filed an amicus curiae (“friend of the court”) brief this week at the U.S. Supreme Court in King v. Burwell, which could decide the fate of Obamacare. The brief argues that by providing tax credits on federal health insurance exchanges, in violation of the law itself, the Obama administration violates the Constitution’s separation of powers.
“The current administration and remaining members of Congress who support the [Affordable Care Act] want the Court and the American public to view the statute as ‘the law of the land’ and some form of an irrevocable compact–subject only to revisions that the Executive Branch sees fit to make arbitrarily on its own,” the crisply-written 17-page Landmark brief argues. “The Executive has in fact made many such revisions to the ACA, with blatant disregard for both the statute’s text and for the legislative process, by ignoring statutory mandates and deadlines and replacing them with new ones out of whole cloth.”
The brief goes on to cite examples of the White House effectively rewriting statutory deadlines and other provisions of the ACA–many of which are also at issue in the separate lawsuit filed by the U.S. House against the Obama administration. In this case, subsidies intended for state exchanges–as an incentive for states to join Obamacare–were extended to federal exchange as well.
Hopefully this disastrous move by Obama can be reversed by US Congressional action.
Marco Rubio was on with Mark Levin tonight to talk Cuba and gave the best interview I’ve heard yet on Cuba from anyone. One of my favorite parts was where he listed four of five reasons why Obama’s new policy toward Cuba won’t help the Cuban people, one being based on how Cuba’s economy is set up so that 90% of all money in Cuba gets taken by the military because nothing is privately owned. Rubio is really quite impressive in his knowledge of Cuba.
He also explains how bad the human rights situation is in Cuba, noting that basically the day before this deal was announced, the Cuban coast guard rammed a boat of migrants that was trying to escape Cuba and one of the passengers is still missing and presumed dead.
